Retningslinjer for behandling av personopplysninger<br \/><\/strong>I v\u00e5r app tilbyr vi ulike tjenester til brukerne v\u00e5re: i) tilgang til \u00f8velser og personlige treningsprogrammer, og ii) konsultasjoner med profesjonelle behandlere, for eksempel fysioterapeuter p\u00e5 nett (\u00abprofesjonelle behandlere\u00bb).<\/p><p>Vi fungerer som behandlingsansvarlig n\u00e5r vi behandler dine personopplysninger i forbindelse med din tilgang til \u00f8velsene og treningsprogrammene v\u00e5re.<\/p><p>Vi fungerer som databehandler p\u00e5 vegne av behandlerne i forbindelse med din bestilling og gjennomf\u00f8ring av konsultasjoner hos profesjonelle behandlere, blant annet n\u00e5r vi stiller tekniske verkt\u00f8y til r\u00e5dighet for videokonsultasjoner, journalnotater, transkripsjon og AI-st\u00f8ttede utkast til journalnotater.<\/p><p>Denne personvernerkl\u00e6ringen omfatter v\u00e5re behandlingsaktiviteter, b\u00e5de n\u00e5r vi opptrer som behandlingsansvarlig og som databehandler. Vi er forpliktet til og ansvarlige for \u00e5 sikre at gjeldende personvernlovgivning overholdes n\u00e5r vi behandler dine personopplysninger.<br \/><br \/><\/p><p><strong><br \/>3. Behandling av personopplysninger<br \/><\/strong>N\u00e5r du registrerer deg i appen \u2013 enten frivillig, ved hjelp av en kupong fra en ekstern part, for eksempel en lege, eller gjennom henvisning fra et helseforsikringsselskap \u2013 kan vi behandle f\u00f8lgende personopplysninger:<\/p><p><strong>Alminnelige personopplysninger:<\/strong><\/p><ul><li>Identitets- og kontaktopplysninger: navn, adresse, telefonnummer, kj\u00f8nn, h\u00f8yde, vekt, kroppsm\u00e5l og alder;<\/li><li>E-postadresse og passord som brukes til \u00e5 logge inn i appen;<\/li><li>Bruker-ID og profilopplysninger fra innlogging via tredjepart (Google eller Apple);<\/li><li>IP-adresse, enhetsidentifikator og nettleserinformasjon;<\/li><li>Chatdata;<\/li><li>Bestillingsopplysninger og tekniske opplysninger i forbindelse med konsultasjoner.<br \/><br \/><\/li><\/ul><p><strong>Sensitive personopplysninger:<\/strong><\/p><ul><li>Diagnostiser;<\/li><li>Spesifikke opplysninger om skaden;<\/li><li>Helseopplysninger, symptomer, opplysninger om behandling og andre opplysninger som kommer frem i forbindelse med konsultasjoner hos profesjonelle behandlere.<\/li><\/ul><p><br \/><strong>Andre opplysninger:<\/strong><\/p><ul><li>Aktivitetsniv\u00e5 p\u00e5 jobb og i fritiden;<\/li><li>Gjennomf\u00f8rte trenings\u00f8kter;<\/li><li>Vurdering av smerteniv\u00e5et ditt;<\/li><li>Internt genererte data som er anonyme, aggregerte, avidentifiserte osv.<\/li><\/ul><p><span style=\"font-weight: 400;\"><br \/>Hvis du deltar i en videokonsultasjon med en profesjonell behandler, kan konsultasjonen, etter ditt samtykke, bli tatt opp og transkribert for \u00e5 st\u00f8tte den profesjonelle behandlerens journalf\u00f8ring. I den forbindelse kan vi behandle lydopptak, transkripsjoner og AI-genererte utkast til journalnotater. Disse opplysningene kan inneholde helseopplysninger og andre opplysninger som fremkommer under konsultasjonen. AI-genererte utkast til journalnotater brukes kun som et st\u00f8tteverkt\u00f8y og skal gjennomg\u00e5s av den profesjonelle behandleren f\u00f8r de brukes som journalnotat.<\/span><br \/><br \/>Hvis du benytter deg av en henvisning fra helseforsikringsleverand\u00f8ren din, behandler vi ogs\u00e5 f\u00f8lgende opplysninger:<\/p><ul><li>Helseforsikringsselskapet;<\/li><li>Opplysninger som er gitt til helseforsikringsselskapet om deg og skaden din, herunder personnummer og helseopplysninger;<\/li><li>Pasientjournaler registrert i appen v\u00e5r fra konsultasjoner med v\u00e5re fagpersoner.<\/li><\/ul><p><br \/>Vi tilbyr p\u00e5loggingsmetoder fra tredjepartsapplikasjoner til appen fra Google og Apple. Hvis du bruker en av disse p\u00e5loggingsmetodene, gir du oss tillatelse til \u00e5 f\u00e5 tilgang til visse kontoopplysninger fra din Google- eller Apple-konto. Injurymap er ikke ansvarlig for Googles eller Apples behandling av dine personopplysninger i denne sammenhengen, og vi henviser til disse tredjepartenes personvernerkl\u00e6ringer for innsikt i deres behandling av dine personopplysninger.<br \/><br \/><\/p><p><strong><br \/>4. Form\u00e5l<\/strong><br \/>Vi behandler dine personopplysninger for \u00e5 drive virksomheten v\u00e5r og levere tjenestene v\u00e5re til deg, blant annet for \u00e5:<\/p><ul><li>Gi deg tilgang til innholdet i appen, inkludert \u00f8velsene v\u00e5re;<\/li><li>Gi deg et s\u00e5 personlig treningsprogram som mulig;<\/li><li>Gj\u00f8re det mulig for deg \u00e5 benytte deg av profesjonelle behandlere;<\/li><li>St\u00f8tte fagpersoner i forbindelse med konsultasjoner, blant annet ved transkripsjon av konsultasjoner og utarbeidelse av utkast til journalnotater;<\/li><li>Kommunisere med deg i appen, inkludert teknisk support;<\/li><li>Administrer kontoen din i appen;<\/li><li>Levere, vedlikeholde og oppdatere tjenestene v\u00e5re og sikre effektiv drift av IT-infrastrukturen v\u00e5r;<\/li><li>Praktikant innen forretningsutvikling, herunder analyse av bruken av appen, produktutvikling og forbedring av tjenestene;<\/li><li>Fremme forskning og akademisk virksomhet, blant annet i samarbeid med v\u00e5re forretningspartnere;<\/li><li>Sikkerhet, for eksempel for \u00e5 forhindre misbruk eller oppdage hacking osv.<\/li><\/ul><p><br \/>Noen personopplysninger samles inn direkte fra deg n\u00e5r du registrerer deg i appen, mens andre personopplysninger samles inn automatisk som en del av din bruk av appen.<br \/><br \/><\/p><p><strong><br \/>5. Rettsgrunnlag for behandling<br \/><\/strong>Vi baserer oss p\u00e5 f\u00f8lgende rettsgrunnlag n\u00e5r vi behandler dine personopplysninger:<\/p><ul><li><em>Berettiget interesse<\/em>: Vi har en berettiget forretningsmessig interesse i \u00e5 behandle enkelte av dine personopplysninger med sikte p\u00e5 intern forretningsutvikling, drift av en effektiv IT-infrastruktur og tjenester i appen, samt for \u00e5 h\u00e5ndheve v\u00e5re vilk\u00e5r og sikre egnede sikkerhetstiltak;<br \/><br \/><\/li><li><em>Oppfyllelse av en avtale<\/em>: N\u00e5r du registrerer deg for \u00e5 bruke appen, behandler vi dine personopplysninger med det form\u00e5l \u00e5 tilby deg v\u00e5re tjenester i samsvar med din foresp\u00f8rsel, herunder tilgang til \u00f8velsene v\u00e5re, et personlig treningsprogram, bestilling av konsultasjoner med profesjonelle behandlere og annet innhold som er inkludert i appen. Vi behandler ogs\u00e5 personopplysninger p\u00e5 dette behandlingsgrunnlaget med det form\u00e5l \u00e5 administrere kontoen din, kommunisere med deg og yte teknisk support.<br \/><br \/><\/li><li><em>Samtykke<\/em>: N\u00e5r vi mottar personopplysninger i forbindelse med at du benytter deg av en henvisning fra helseforsikringsleverand\u00f8ren din, samtykker du i at helseforsikringsleverand\u00f8ren deler dine personopplysninger med oss, herunder helseopplysninger. Hvis en konsultasjon blir tatt opp og transkribert med det form\u00e5l \u00e5 st\u00f8tte journalf\u00f8ring, vil den profesjonelle behandleren be deg om samtykke f\u00f8r opptaket starter. Samtykket kan gis muntlig til den profesjonelle behandleren, som registrerer samtykket i systemet. Du kan avsl\u00e5 opptak og transkripsjon og likevel gjennomf\u00f8re konsultasjonen.<br \/><br \/><\/li><li><em>Rettslig forpliktelse<\/em>: Noen ganger kan vi v\u00e6re rettslig forpliktet til \u00e5 behandle dine personopplysninger for \u00e5 oppfylle v\u00e5re rettslige forpliktelser.<br \/><br \/><\/li><li><em>Helsefaglig behandling og journalf\u00f8ring<\/em>: N\u00e5r opplysninger behandles som ledd i helsefaglig behandling, journalf\u00f8ring eller dokumentasjon av et behandlingsforl\u00f8p, kan behandlingen skje p\u00e5 grunnlag av reglene om helsetjenester, journalf\u00f8ring og behandling av helseopplysninger i henhold til gjeldende personvern- og helselovgivning.<\/li><\/ul><p><strong><br \/><br \/><br \/>6. Utveksling\/deling av personopplysninger<\/strong><br \/>Vi kan utveksle eller dele dine personopplysninger med tredjeparter til de form\u00e5lene som er beskrevet i denne personvernerkl\u00e6ringen. Dette omfatter utveksling og\/eller deling med f\u00f8lgende kategorier av tredjeparter:<\/p><p><strong>V\u00e5re databehandlere:<br \/><\/strong>N\u00e5r du registrerer deg for \u00e5 bruke appen, samtykker du i og gir oss fullmakt til \u00e5 dele eller utlevere dine personopplysninger til tredjeparter som bist\u00e5r oss i leveringen av v\u00e5re tjenester. Vi inng\u00e5r databehandleravtaler med v\u00e5re databehandlere for \u00e5 sikre at de overholder gjeldende personvernlovgivning.<\/p><p>Dette omfatter blant annet leverand\u00f8rer av hosting, IT-drift, support, videokonsultasjoner, transkripsjon og AI-st\u00f8ttet journalf\u00f8ring. Vi bruker Corti ApS som teknologileverand\u00f8r for transkripsjon og AI-st\u00f8ttet strukturering av konsultasjonsdata. Corti behandler opplysninger p\u00e5 v\u00e5re instrukser med det form\u00e5l \u00e5 levere transkripsjon, oppsummering, strukturering og tilh\u00f8rende teknisk funksjonalitet til bruk for profesjonelle behandleres journalf\u00f8ring.<\/p><p>Dersom det er n\u00f8dvendig \u00e5 overf\u00f8re dine opplysninger utenfor EU\/E\u00d8S for \u00e5 oppfylle ett eller flere av form\u00e5lene, vil en slik overf\u00f8ring til tredjeland kun skje i samsvar med gjeldende personvernlovgivning og v\u00e6re basert p\u00e5 et gyldig overf\u00f8ringsgrunnlag, dvs. EU-kommisjonens standardavtaler eller andre relevante overf\u00f8ringsgrunnlag. Hvis du \u00f8nsker \u00e5 motta en liste over overf\u00f8ringer til tredjeland, kan du bruke kontaktopplysningene i denne personvernerkl\u00e6ringen.<\/p><p>Du kan laste ned appen via en plattform som drives av en tredjepart, for eksempel App Store, Google Play osv. Vi har ingen kontroll over personopplysningene dine som behandles av disse tredjepartene, da de ikke er tilknyttet eller kontrollert av Injurymap. Bruk av appen kan derfor v\u00e6re underlagt ytterligere personvernerkl\u00e6ringer fra tredjeparter.<\/p><p><strong>Profesjonelle behandlere:<br \/><\/strong>Som en tjeneste tilbyr vi muligheten til \u00e5 bestille konsultasjoner med en profesjonell behandler. Denne tjenesten kan utf\u00f8res ved hjelp av en henvisning fra helseforsikringsleverand\u00f8ren din. Helseforsikringsleverand\u00f8ren innhenter samtykke til behandlingsaktivitetene, herunder utveksling av personopplysninger med oss og v\u00e5re profesjonelle behandlere.<\/p><p>Injurymap kan ogs\u00e5 rapportere epikrisene til helseforsikringsleverand\u00f8ren. Dette kan kun skje med ditt uttrykkelige samtykke. Helseforsikringsleverand\u00f8ren er ansvarlig for \u00e5 innhente ditt samtykke til rapportering av epikrisen.<\/p><p>Disse behandlerne fungerer som behandlingsansvarlige, og vi som deres databehandler, ved at vi gir behandlerne tilgang til appdataene v\u00e5re, slik at de kan f\u00e5 tilgang til brukerdata som er n\u00f8dvendige for \u00e5 sikre effektive og relevante konsultasjoner. Dette kan ogs\u00e5 omfatte tilgang til transkripsjoner og utkast til journalnotater dersom det er gitt samtykke til opptak og transkripsjon av konsultasjonen.<\/p><p><strong>Ansatte hos forretningspartnere, for eksempel helseforsikringsselskaper:<br \/><\/strong>Hvis du har blitt henvist til \u00e5 bruke tjenestene v\u00e5re av helsepersonell eller gjennom helseforsikringsselskapet ditt, kan vi dele relevante brukerdata med utvalgt personale hos disse samarbeidspartnerne. Deling av data er strengt begrenset til \u00e5 st\u00f8tte og forbedre behandlingsforl\u00f8pet ditt og bruken av appen. All deling av data skjer i samsvar med gjeldende personvernlovgivning, og kun autorisert personale i partnerorganisasjonen vil ha tilgang til opplysningene dine.<\/p><p><strong>Forsknings- og forretningspartnere:<br \/><\/strong>Injurymap legger til rette for vitenskapelig og akademisk forskning i samarbeid med v\u00e5re forretningspartnere. Dette kan omfatte deling av dine personopplysninger med v\u00e5re forretningspartnere for \u00e5 gjennomf\u00f8re kommersiell og akademisk forskning vedr\u00f8rende demografi, interesser og forbrukerpreferanser for \u00e5 f\u00e5 innsikt i v\u00e5re brukere, produkter og tjenester og bruke dette til i) interne form\u00e5l og ii) \u00e5 forbedre kunnskapen om trening basert p\u00e5 aggregerte eller avidentifiserbare data.<\/p><p><strong>Bedriftstransaksjoner og omorganiseringer:<br \/><\/strong>Vi kan p\u00e5 et tidspunkt beslutte \u00e5 selge noen av v\u00e5re eiendeler og virksomheter \u2014 helt eller delvis \u2014 til andre selskaper. Slike transaksjoner kan omfatte kundeopplysninger og dermed dine personopplysninger og brukerdata. Lagring og sletting av data<br \/><\/strong>Vi behandler dine personopplysninger s\u00e5 lenge du har en aktiv konto i appen.<\/p><p>Du kan n\u00e5r som helst redigere kontoen din. Du kan ogs\u00e5 slette kontoen din. Hvis du sletter kontoen din, sletter vi umiddelbart personopplysningene dine eller anonymiserer dem.<\/p><p>Vi kan n\u00e5r som helst slette kontoen din og de tilknyttede personopplysningene dersom din bruk av appen er i strid med v\u00e5re nettvilk\u00e5r.<\/p><p>Vi oppbevarer kun dine personopplysninger lenger dersom det er n\u00f8dvendig for oss for \u00e5 overholde lovp\u00e5lagte forpliktelser eller h\u00e5ndheve v\u00e5re nettvilk\u00e5r.<\/p><p>Lyd- og eventuelle videoopptak fra konsultasjoner lagres kun s\u00e5 lenge det er n\u00f8dvendig for \u00e5 transkribere konsultasjonen, utarbeide et utkast til journalnotat, h\u00e5ndtere tekniske feil eller sikre korrekt dokumentasjon. N\u00e5r de n\u00f8dvendige opplysningene er overf\u00f8rt til journalen, slettes eller anonymiseres r\u00e5opptaket, med mindre lengre lagring er n\u00f8dvendig for \u00e5 overholde lovgivning, dokumentere behandling, h\u00e5ndtere klager eller beskytte rettskrav. Transkripsjoner og journalnotater som inng\u00e5r i pasientjournalen, lagres i henhold til reglene og lagringsfristene som gjelder for pasientjournaler og \u00f8vrige helseopplysninger.<\/p><p><strong><br \/><br \/>8. Dine rettigheter<\/strong><br \/>I henhold til GDPR har du visse rettigheter n\u00e5r det gjelder personopplysningene vi behandler:<\/p><ul><li>Du har rett til innsyn i opplysningene vi behandler om deg, samt visse andre opplysninger;<\/li><li>Du har rett til \u00e5 f\u00e5 uriktige personopplysninger om deg rettet;<\/li><li>I s\u00e6rlige tilfeller har du rett til \u00e5 f\u00e5 personopplysninger om deg slettet f\u00f8r v\u00e5rt generelle slettetidspunkt;<\/li><li>I visse tilfeller har du rett til \u00e5 begrense behandlingen av dine personopplysninger;<\/li><li>I visse tilfeller har du rett til \u00e5 gj\u00f8re innsigelse mot v\u00e5r ellers lovlige behandling av dine personopplysninger; og<\/li><li>I visse tilfeller har du rett til \u00e5 motta dine personopplysninger i et strukturert, alminnelig anvendt og maskinlesbart format, og til \u00e5 overf\u00f8re slike personopplysninger fra \u00e9n behandlingsansvarlig til en annen uten hindringer (dataportabilitet).<\/li><li>Hvis behandlingen er basert p\u00e5 ditt samtykke, har du rett til \u00e5 trekke samtykket tilbake. Dette p\u00e5virker ikke lovligheten av behandlingen som har funnet sted f\u00f8r tilbaketrekkingen.<\/li><\/ul><p><strong><br \/><br \/>9.
